Indy Back In Balance ("Indy Back In Balance," "we," "us," or "our") respects your privacy and is committed to protecting the information you share with us. This Privacy Policy explains what information we collect, how we use it, and the choices you have. It applies to information collected through our website at indybackinbalance.com (the "Site") and through services provided at our practice located at 11650 N. Lantern Road, Suite 230, Fishers, IN 46038 (the "Services").

By using the Site or our Services, you agree to the collection and use of information in accordance with this Policy.

1. Information We Collect

We collect the following categories of information:

  • Contact information you provide through forms, email, phone, or our online booking system, including name, email address, phone number, and mailing address.
  • Appointment and intake information, including service requested, date and time of visit, and information you provide on intake forms about your medical history, current symptoms, medications, injuries, and treatment goals.
  • Payment information processed through our third-party payment processors. We do not store full credit or debit card numbers on our systems.
  • Communications you send us, including messages submitted through our contact form, email replies, and text messages.
  • Automatically collected data, including IP address, browser type, device type, pages visited, referring URL, and approximate location, collected through cookies and similar technologies (see Section 6).

2. How We Use Your Information

We use the information we collect to:

  • Schedule, confirm, reschedule, and follow up on appointments;
  • Provide and personalize bodywork, scoliosis care, and related Services;
  • Maintain treatment records and communicate with you about your care;
  • Process payments and maintain billing records;
  • Respond to inquiries and customer service requests;
  • Send appointment reminders, follow-ups, and (with your consent) promotional messages;
  • Operate, secure, and improve the Site;
  • Comply with applicable laws, including Indiana professional licensing requirements; and
  • Enforce our Terms of Service and protect our rights.

3. Health Information and Professional Confidentiality

Indy Back In Balance is a massage therapy and bodywork practice. We are not generally considered a "covered entity" under the federal Health Insurance Portability and Accountability Act (HIPAA) unless we electronically transmit health information in connection with insurance claims. Regardless, we treat the personal health information you share with us — including intake forms, treatment notes, and any health conditions discussed during a session — as confidential.

We will not disclose your health information to third parties except: (a) with your consent; (b) to the licensed practitioner providing your care; (c) when required by Indiana law, court order, or subpoena; (d) to prevent serious harm to you or others; or (e) as otherwise permitted by Indiana Code 25-21.8 governing massage therapy practice.

4. How We Share Information

We do not sell your personal information. We share information only as follows:

  • Service providers who support our business, such as scheduling and booking platforms, payment processors, email and SMS providers, hosting providers (including Vercel), and analytics providers. These providers are contractually limited to using the information for the services they perform for us.
  • Legal and safety: when required by law, regulation, legal process, or governmental request, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of assets, in which case we will require the recipient to honor this Policy.

5. Cookies and Analytics

Our Site uses cookies and similar technologies to remember your preferences and to understand how visitors use the Site. We use Vercel Analytics to collect aggregated, non-identifying information about Site usage (such as page views and referring URLs) so we can improve our content.

You can configure your browser to refuse or delete cookies. Some parts of the Site may not function properly if cookies are disabled.

6. SMS and Email Communications

If you provide your phone number, we may send appointment reminders, scheduling messages, and (with your consent) promotional text messages. Message and data rates may apply. Reply STOP to opt out of text messages at any time, or HELP for help. Opting out of promotional messages will not stop transactional messages related to existing appointments.

You can unsubscribe from marketing emails by clicking the "unsubscribe" link in any email or by contacting us. Even if you opt out of marketing, we may still send you transactional messages about your appointments and account.

7. Data Security

We use reasonable administrative, technical, and physical safeguards to protect your information, including secure transmission of data submitted through our Site. No method of transmission or storage is 100% secure, however, and we cannot guarantee absolute security.

In the event of a security incident affecting personal information, we will notify affected individuals as required by the Indiana Disclosure of Security Breach Act (Indiana Code 24-4.9) and any other applicable law.

8. Your Choices and Rights

You may:

  • Request access to or a copy of the personal information we hold about you;
  • Request correction of inaccurate information;
  • Request deletion of your information, subject to recordkeeping obligations imposed by Indiana law on licensed massage therapy practices;
  • Withdraw consent for marketing communications at any time; and
  • Object to or restrict certain processing of your information.

To exercise any of these rights, contact us using the information at the bottom of this page. We will respond within a reasonable time and may verify your identity before fulfilling the request.

9. Children's Privacy

Our practice provides care to minors ages 9 and above, including pediatric scoliosis clients. Any minor receiving care must be accompanied by a parent or legal guardian, who is responsible for completing intake forms and providing informed consent for treatment. Health information collected during treatment is handled with the same confidentiality described in Section 3.

The Site itself is not directed to children under 13, and we do not knowingly collect personal information online from children under 13. If you believe a child under 13 has submitted personal information through the Site, please contact us and we will delete it.

10. Third-Party Links

The Site may contain links to third-party websites, including our online booking platform, social media accounts, and embedded Google Maps. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing them with information.

11. Indiana Residents

Indiana does not currently have a comprehensive consumer privacy statute comparable to the California Consumer Privacy Act, but Indiana residents are protected by laws including the Indiana Disclosure of Security Breach Act (IC 24-4.9), the Indiana Telephone Solicitation of Consumers law (IC 24-4.7), and the confidentiality protections applicable to licensed massage therapy practice (IC 25-21.8). Nothing in this Policy limits any rights you have under those laws.

12. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be communicated through the Site or, where appropriate, by email. Your continued use of the Site or Services after a change becomes effective constitutes acceptance of the updated Policy.
