Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website at indybackinbalance.com (the "Site") and the bodywork, scoliosis care, and related services (the "Services") provided by Indy Back In Balance ("Indy Back In Balance," "we," "us," or "our") at our practice located at 11650 N. Lantern Road, Suite 230, Fishers, IN 46038.

By using the Site, booking an appointment, or receiving Services from us, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or our Services.

1. Eligibility

You must be at least 18 years old to book an appointment or enter into these Terms. Minor clients may receive Services with the consent and presence of a parent or legal guardian, who is responsible for completing intake paperwork and accepting these Terms on the minor's behalf.

2. Nature of Services — Not a Substitute for Medical Care

Indy Back In Balance provides massage therapy, mechanical bodywork, scoliosis-focused manual therapy (including Theraflex protocol), reflex therapy, and related wellness services. Our Services are intended to support relaxation, recovery, mobility, and general wellness.

Our Services are not a substitute for diagnosis, treatment, or care from a licensed physician or other healthcare provider. We do not diagnose medical conditions or prescribe medication. You should consult a qualified medical professional regarding any medical condition, and you should not rely on our Services in place of medical care. If you are experiencing a medical emergency, call 911.

3. Health Disclosures and Consent

You agree to provide accurate and complete information on intake forms, including relevant medical history, injuries, current medications, allergies, and any conditions that may affect your care (including pregnancy, recent surgery, infectious illness, or cardiovascular conditions). Failure to disclose relevant information may compromise your safety, and we are not responsible for adverse outcomes resulting from undisclosed conditions.

You consent to the bodywork techniques selected by your practitioner and may withdraw consent at any time during a session. You also acknowledge that bodywork carries some risk of soreness, bruising, or temporary discomfort, and that individual results vary.

4. Booking, Cancellation, and No-Show Policy

Appointments may be booked online, by phone, or by email and are by appointment only. We ask that you arrive on time; arrivals more than fifteen (15) minutes late may result in a shortened session or rescheduling at our discretion, and you may still be charged the full price of the scheduled service.

Cancellation Policy. We require at least forty-eight (48) hours' notice to cancel or reschedule an appointment without charge. Cancellations made with less than 48 hours' notice may be subject to a fee of up to 50% of the scheduled service price. No-shows may be charged the full price of the scheduled service. Out-of-town and travel-package clients may be subject to additional cancellation terms communicated at the time of booking.

We reserve the right to reschedule or cancel appointments due to practitioner illness, emergencies, or other unforeseen circumstances. In such cases we will offer to reschedule.

5. Payment, Pricing, and Refunds

Service prices are listed on the Site or quoted at booking and are payable at the time of service unless otherwise agreed. We accept payment through our scheduling and payment platforms. Sales tax is added where required by Indiana law.

Refunds. Services that have been rendered are generally non-refundable. If you believe a session did not meet a reasonable standard of care, please contact us within seven (7) days and we will work in good faith to resolve the issue, which may include a credit toward a future session.

Packages and Gift Certificates. Prepaid packages and gift certificates are non-refundable, non-transferable for cash, and subject to any expiration dates disclosed at purchase, in accordance with Indiana gift certificate law.

6. Code of Conduct and Right to Refuse Service

We are committed to providing a safe, professional environment for our clients and practitioners. Disrespectful behavior, harassment, intoxication, requests for services outside the scope of professional bodywork, or any conduct that compromises the safety of staff or other clients will result in immediate termination of the session without refund and may result in being barred from future appointments.

We reserve the right to refuse, discontinue, or condition Services in our sole professional judgment, including for medical contraindications.

7. Communications

By providing your phone number or email address, you consent to receive transactional messages related to your appointments, including reminders and follow-ups. With your separate consent, we may also send promotional messages. You may opt out of marketing messages at any time, as described in our Privacy Policy.

8. Site Use and Intellectual Property

All content on the Site — including text, photographs, video, logos, graphics, and the "Indy Back In Balance" name — is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and download content for personal, non-commercial use only. You may not copy, reproduce, modify, distribute, or create derivative works from Site content without our prior written consent.

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to interfere with the Site's operation or security; (c) use automated tools to scrape or harvest content; or (d) impersonate any person or misrepresent your affiliation with any person or entity.

9. Third-Party Links and Services

The Site may contain links to third-party websites and services, including our online booking platform and embedded maps. We do not control and are not responsible for those third parties or their content, terms, or privacy practices. Your use of those services is governed by their own terms and policies.

10. Disclaimer of Warranties

The Site and the Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by Indiana law, we disclaim all warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Services will achieve a particular outcome. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the fullest extent permitted by law, in no event will Indy Back In Balance, its owners, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Site or Services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to these Terms, the Site, or the Services will not exceed the greater of (a) the amount you paid us for the specific Service giving rise to the claim, or (b) one hundred dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Indy Back In Balance and its owners, employees, contractors, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site or Services; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) your failure to disclose relevant health information.

13. Photography and Marketing

We will not photograph, record, or use your name or likeness for marketing without your separate written consent. You may revoke that consent at any time by contacting us; we will discontinue future uses, although we may not be able to remove your likeness from materials already in distribution.

14. Modifications to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be communicated through the Site or, where appropriate, by email. Your continued use of the Site or Services after a change becomes effective constitutes acceptance of the updated Terms.

15. Governing Law and Venue

These Terms and any dispute arising out of or relating to them, the Site, or the Services are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles. You agree that any action or proceeding shall be brought exclusively in the state or federal courts located in Hamilton County, Indiana, and you consent to the personal jurisdiction of those courts.

16. Dispute Resolution

Before filing a claim, you agree to first contact us in writing and attempt to resolve the dispute informally for at least thirty (30) days. If we cannot resolve the dispute informally, either party may pursue the dispute in the courts identified in Section 15. Nothing in these Terms limits your right to file a complaint with the Indiana Attorney General's Consumer Protection Division or with the Indiana Professional Licensing Agency regarding licensed massage therapy practice.

17. Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy and any other policies referenced on the Site, constitute the entire agreement between you and Indy Back In Balance regarding the Site and the Services.
